In a dispatch from a recent industry event, Kelly goes over what we know about USCIS audits and what those who’ve been through them are saying.

Ever since the passage of the EB-5 Reform and Integrity Act of 2022 (RIA), stakeholders of the EB-5 Immigrant Investor Program have wondered when U.S. Citizenship and Immigration Services (USCIS) would begin auditing Regional Centers as promised by the RIA. In 2024, those audits finally commenced, and Regional Centers have eagerly awaited word on what audits would entail and how they should prepare for when their number is called.

That’s why JTC and Invest In the USA (IIUSA) held a virtual event featuring a panel of individuals who’d been among the first to experience USCIS audits. At the event, the panelists went through their experiences, what the dynamic with auditors had been like, and some of the surprising elements of the audit process.

JTC’s Laura Kelly attended the webinar and wrote a full recap for IIUSA. In the article, she breaks down some of the most important advice from the webinar panel, including what kind of information auditors are asking for, how long Regional Centers have to respond to requests, and ways to make in-person site visits easier.
