Justin Amos Discusses 1031 on Real Estate Investing Podcast

28th Jan 2025

As a guest on Commercial Real Estate Simplified, Justin shared some of the wisdom he’s gained through many years in 1031.

JTC Senior National Sales Manager and 1031 Specialist Justin Amos appeared as a guest on Commercial Real Estate Simplified, a new show that helps simply complex topics into actionable tips for beginning real estate investors and those looking to expand their portfolios with new strategies.

As an expert in 1031 exchanges, Justin joined host Tsovo Massena to share his expertise into everything from 1031 basics to more intricate topics like carry-over depreciation and moving from active to passive investments. Justin drew on his years of experience across many types of exchanges to outline some of the most common misconceptions about like-kind exchanges and the mistakes he sees most often that can cause exchanges to fail.

“Making sure you have a good team around you” is key, said Amos. “Even though the 1031 exchange has been in the tax code for now over 100 years, it’s still a specialized transaction. Not all CPAs are very familiar with it. Not all real estate agents are familiar.”

That’s especially true when choosing a Qualified Intermediary (QI) to hold funds during the exchange.

“The Qualified Intermediary industry is still an unregulated industry, so there’s not a set of rules or regulations that each QI needs to follow,” he said. “Some QIs still co-mingle funds.”

The solution is to perform proper due diligence and ask the right questions to make sure your QI follows 1031 best practices.

“A good team that supports you is ultimately going to lead to success,” said Amos. “It could be very expensive to make the wrong choice.”

The discussion also covered strategies of successful 1031 investors, the likelihood of changes to Section 1031 in the future, and advice for first-time exchangers. After listening, check out the 1031 Exchange Guide and 1031 Exchange Checklist mentioned in the show. Congratulations to Justin for getting out there and sharing his expertise!
