EB-5 Investment Deadline 2026: Should Investors Rush or Wait for the Right Project?

The EB-5 investment deadline of September 30, 2026 is fast approaching, and with it, a critical question for investors: act quickly, or wait for the right opportunity?

EB-5 faces a crossroads this year, as September 30th, 2026 brings the grandfathering deadline for the EB-5 Reform and Integrity Act of 2022 (RIA). After this date, applicants can’t be assured their applications will be adjudicated under the RIA’s provisions, and the Regional Center Program’s authorization is set to sunset one year later, on September 30th, 2027.

Will the EB-5 Regional Center Program be reauthorized beyond 2027?

At JTC’s recent EB-5 webinar, the panelists discussed two major questions facing EB-5 right now: will the Regional Center program be reauthorized beyond 2027? And how should investors manage trying to get their applications in before the deadline?

As for the first question, there was a good deal of optimism. Many of the panelists believed the grandfathering deadline would be extended, and that the Regional Center Program has a good chance of reauthorization, thanks to efforts in Washington to educate Congress on the value of EB-5.

“I think a lot of folks on the hill know about the program and know about the great things that the folks here are doing,” said Carolyn Lee of Carolyn Lee PLLC.

Should EB-5 Investors Rush to Meet the 2026 Deadline?

Regarding the second question, there was consensus that the industry is likely to see a rush of EB-5 investment leading up to the grandfathering deadline. But this could be a mistake if investors, in their eagerness to get their applications in before the EB-5 investor deadline, fail to do proper due diligence.

“You’re going to see different gimmicks out there,” said Noreen Hogan of CMB Regional Centers. “If it’s flashy, you should ask ten more questions than you otherwise would.”

Nathan Hale of Law360 attended the webinar and has published an account. As he relates, the panelists urged caution to investors, who may be wise to hold off on investing if they are unsure of the viability of the project on offer.

“Focus on quality still has to be number one,” said Sebastian Stubbe of Pine State Regional Center.
