JTC Special Situations’ Anna Silver highlights ‘alternative thinking’ around enforcement at BVI Conference

The importance of shifting away from ‘traditional’ thinking and moving towards alternative approaches to BVI enforcement was one of the key themes to come under the spotlight at the recently held RISA and South Square BVI Conference – where JTC Special Situations Senior Director Anna Silver was a speaker.

The conference, held on 17 June at the Long Bay Beach Resort in Tortola, brought together both local and international practitioners, legal experts and other stakeholders working across the liquidation, insolvency and enforcement space to discuss key trends shaping the BVI and wider cross-border disputes landscape.

Speaking in one panel session at the event, Anna highlighted how litigation now needs to be treated as one tool amongst many in the modern financing and recovery lifecycle, prompting a shift away from traditional thinking and a move towards a fresh approach to enforcement. This was particularly important against the backdrop of increasingly complex cross-border enforcement cases, where evidence gathered in one jurisdiction may not travel cleanly due to differences in legal systems and cultural expectations.

Other panel sessions also covered recent developments in BVI fiduciary law, conflicts in liquidation and the opportunities and challenges presented by the rise of digital assets and artificial intelligence.

Commenting after the event, Anna said: “The clear message from the conference this year is that the landscape is evolving. When it comes to litigation, disputes and enforcement, the pressure is now global – and so is the risk.

“That means that we need to move on from the traditional focus on winning a case, towards alternative approaches that are more focused on extracting value. And that has a major impact on how we need to approach disputes, right from the outset.”
